PAIA GUIDE & MANUAL OVERVIEW

Prepared in accordance with Section 51 of the Promotion of Access to Information Act, No. 2 of 2000

1. Introduction

This Guide provides an overview of the records held by D-Portfolio Investments (Pty) Ltd (Registration No. 2024/004292/07), trading as The Portfolio, and the formal procedure for requesting access to such records pursuant to the Promotion of Access to Information Act, No. 2 of 2000 (PAIA) and the Protection of Personal Information Act, No. 4 of 2013 (POPIA).

3. Categories of Records Held

• Statutory & Corporate Records: Memorandum of Incorporation, CIPC registration documents, board minutes, and director registers.
• Financial & Operating Records: Accounting records, tax returns, management accounts, and bank records.
• Commercial & Client Records: Advisory contracts, mandate agreements, Non-Disclosure Agreements, client engagement documentation, and counterparty KYC verification files.
• Personnel & Service Provider Records: Employment contracts, contractor service level agreements, and vendor documentation.

4. Procedure for Requesting Access

Requests for access to records must be submitted to the Information Officer using the prescribed PAIA Form 2 (available on the Information Regulator website at inforegulator.org.za) together with the prescribed request fee and proof of identity.

The requester must clearly state the right they seek to exercise or protect and provide sufficient detail regarding the requested record.

5. Grounds for Refusal of Access

Access to certain records may be refused pursuant to Chapter 4 of PAIA, including mandatory protection of the commercial confidentiality of third parties, trade secrets, confidential corporate models, privileged legal communications, or personal information protected under POPIA.
